This Refund & Cancellation Policy explains how subscription cancellations, renewals, refunds and billing corrections are handled for EagleEnforce™. EagleEnforce is operated by LaFountain Design, doing business as EcommEagle®, of 170 Highland Rd, Ste 1, Massena, NY 13662, United States.
Read this policy together with the Terms of Service and the Privacy Policy. It forms part of the Terms.
The short version. Except where the law requires otherwise or we expressly say otherwise, payments for EagleEnforce subscriptions are non-refundable once processed.
Cancelling stops the next renewal. It does not refund the term you are in, and your access normally continues to the end of the period you have already paid for.
1. Free trials
EagleEnforce offers a free trial before you buy a paid subscription. For accounts created directly at eagleenforce.com the trial is currently 14 days. The trial:
- does not require a payment card;
- does not create a subscription charge during the trial; and
- does not convert into a paid subscription on its own.
To start a paid subscription you have to choose a plan and enter a payment method yourself. Because no subscription fee is charged during the trial, there is ordinarily no trial payment to refund.
Trial accounts run with the allowances of the entry plan, including a limit on the number of products and listings watched and on evidence retention. Those limits are shown in the application.
2. Monthly subscriptions
Monthly subscriptions are billed in advance for each monthly billing period.
Once a monthly payment has been processed it is non-refundable, except where applicable law requires otherwise or where we determine that a billing correction is appropriate. We do not ordinarily provide refunds, credits or reimbursements for an unused part of a monthly period.
You can cancel future renewal at any time from the Account page in the application. Unless the cancellation screen says otherwise, cancelling prevents the next renewal charge but does not end your access immediately: the subscription normally stays active through the end of the monthly period you have already paid for.
3. Annual subscriptions
Annual subscriptions are billed in advance for a twelve-month term.
Annual plans may be offered at a discounted rate compared with paying month by month for the same period. The discount, where offered, is given in exchange for paying for the full annual term in advance. The exact annual price for your plan is shown in the application before you subscribe and is confirmed on your invoice.
Once an annual payment has been processed it is non-refundable, except where applicable law requires otherwise or where we determine that a billing correction or another exceptional remedy is appropriate.
We do not provide prorated refunds for:
- unused months;
- unused days;
- early cancellation;
- reduced usage;
- features you did not use; or
- the part of an annual term remaining after cancellation.
Promotional months and annual savings have no independent cash value.
4. Cancelling an annual subscription
You can cancel future renewal of an annual subscription at any time. Cancelling annual renewal:
- stops the subscription renewing at the end of the current term;
- does not normally produce an immediate refund;
- does not create a prorated refund for unused time; and
- normally lets you keep using EagleEnforce until the annual term you have paid for expires.
If you do not want an annual subscription to renew, cancel before the renewal date.
5. Annual renewals
Paid plans are subscriptions and renew automatically at the then-current price for your plan until you cancel. We give account holders at least 30 days' notice by email before a price change takes effect at renewal, and you may cancel before it does.
Once a renewal payment has been processed it is non-refundable except where:
- applicable law requires otherwise;
- the charge resulted from a confirmed billing error;
- the payment was duplicated;
- the transaction is verified as unauthorized; or
- we approve another exceptional remedy.
No prorated refund is provided for an unused part of a renewed term.
6. No prorated refunds
We do not ordinarily provide prorated refunds for partly used subscription periods. This includes monthly subscriptions, annual subscriptions, renewals, downgrades, early cancellation, periods in which you did not use the Service, and periods in which you used only part of it.
Choosing to stop using EagleEnforce before the end of a paid period does not create a right to money back for the remaining time.
7. Plan upgrades
If you move to a higher-priced plan, an additional amount may be charged according to the billing terms shown during the upgrade. The amount and the timing depend on your existing subscription, the new plan, the point in the billing period at which you upgrade, and the rules applied by our payment provider. The effective date is shown in the application when the change is made.
Upgrade charges are generally non-refundable once processed, subject to the exceptions in this policy.
8. Plan downgrades
A downgrade does not ordinarily produce a refund or a cash credit for the difference between plans. Depending on the subscription and the payment provider, a downgrade may take effect at the next billing period, at the next renewal, or on another date shown during the change.
Plan allowances change when the downgrade takes effect. If your account then holds more products or listings than the new plan allows, existing data is not deleted for that reason, but new items beyond the limit are not added until you upgrade again.
9. Discounts, promotions and credits
Promotional pricing, coupons, annual discounts, free months and account credits have no independent cash value unless we state otherwise or the law requires it. Unused promotional value is not refundable, and unused promotional months or discounts cannot be exchanged for cash.
10. Payment processing
EagleEnforce subscriptions are sold directly by us and payments are processed by Square (Block, Inc.). Card details are entered into a payment form served by Square and are held by Square. We do not receive or store full payment-card numbers; our records keep the card brand and last four digits, the subscription status, and invoice and payment history.
Where a refund or billing correction is approved it will normally be returned through the original payment method whenever that is reasonably possible. How long funds take to appear afterwards depends on the payment processor, the card network and your bank, and is outside our control.
11. Billing errors
If you believe you were charged incorrectly, contact us promptly. We may correct confirmed duplicate charges, incorrect subscription charges, payment-processing errors and other billing mistakes attributable to us. A billing correction is not the same thing as a general subscription refund.
When you write to us about billing, never send passwords, full card numbers, API credentials or store credentials.
12. Unauthorized transactions
Report any transaction you believe was unauthorized as soon as you can. We may need reasonable information to verify account ownership, identify the transaction and investigate. Verified unauthorized transactions are handled according to applicable law, the requirements of the payment provider and the circumstances of the transaction.
For your protection, changing a subscription or a plan in the application requires confirmation with a code sent to the email address on your account, and only an account owner can cancel a subscription.
13. Service interruptions
A temporary interruption does not automatically create a right to a refund. Interruptions can arise from, among other things:
- scheduled maintenance;
- temporary EagleEnforce outages;
- dealer website outages or changes;
- ecommerce platform outages;
- third-party API outages;
- network or hosting failures;
- payment-provider outages;
- changes to robots.txt or other access rules;
- rate limiting or blocking by a monitored website; or
- other circumstances outside our reasonable control.
Where EagleEnforce has a substantial service failure that is directly attributable to us, we may, at our discretion and where the law permits, offer a billing adjustment, a refund or another appropriate remedy. We do not offer a service-credit scheme, and nothing in this section limits a remedy that applicable law requires.
14. Dealer website and third-party availability
EagleEnforce monitors websites and uses third-party systems that we do not control. A refund does not automatically become due because:
- a dealer website changes its design, platform or page structure;
- a dealer website becomes unavailable;
- robots.txt or another access rule prevents monitoring;
- a site owner opts out of monitoring;
- a website begins blocking automated access;
- a product listing is removed or goes out of stock;
- a price stops being shown publicly;
- a listing cannot be matched reliably to your catalog;
- a third-party platform changes or withdraws an API;
- a platform imposes rate limits or has downtime; or
- credentials for a connected service expire or are revoked.
We honour robots.txt and do not attempt to work around a site that declines to be read, so a site that opts out stays out. Where practicable we will identify and tell you about compatibility problems of this kind, and the application reports why a listing could not be read.
15. Account suspension or termination
Subject to applicable law, we do not ordinarily provide refunds where an account is suspended or terminated for a material violation involving fraud or attempted fraud, abusive or malicious activity, unauthorized access, deliberate circumvention of usage limits, misuse of a connected store or dealer website, chargeback abuse, or another material breach of the Terms of Service. Nothing in this section removes rights that cannot legally be waived.
16. Chargebacks and payment disputes
If you believe a charge is wrong, contact us first so it can be investigated. Starting a chargeback does not by itself cancel the underlying subscription. Where permitted, we may temporarily restrict an account with an unresolved payment dispute while the matter is looked into. Nothing in this section limits legitimate payment-dispute rights.
17. How to contact EagleEnforce about billing
Email support@ecommeagle.com, or, if you are signed in, open a ticket from the Support page in the application. Please include:
- the email address on the account;
- the approximate billing date;
- the plan involved;
- what appears to be wrong; and
- enough detail for us to identify the transaction.
Do not send passwords, full card numbers, API keys or store credentials.
18. Approved refunds or billing corrections
Although subscription payments are generally non-refundable, we may issue a refund or an adjustment under one of the limited exceptions described here. An approved refund is normally submitted through the original payment method where possible. The time taken for the money to appear depends on the payment processor, the card network and the bank, and those timings are outside our direct control.
19. Taxes and third-party fees
Sales tax is added where the law requires, calculated from the billing address you give us; keeping that address accurate is your responsibility. Taxes, currency-conversion charges, bank fees and similar amounts may be governed by separate legal or payment-provider rules. Where a refund or correction is issued, related taxes are handled according to applicable law and what the payment processor supports. We cannot guarantee reimbursement of fees charged independently by a bank, a card issuer or another third party.
20. Rights required by law
Nothing in this policy is intended to remove or restrict statutory refund rights, cancellation or withdrawal rights, consumer-protection rights, warranty rights or other remedies that cannot legally be waived. Where applicable law gives you greater rights than this policy, the law controls.
21. Changes to this policy
We may update this policy from time to time. Material changes apply going forward unless the law requires otherwise. The "Last updated" date at the top of this page shows when it was last revised.
